Inside the 2025 statewide drunk driving audit

Every year the Michigan State Police publishes the Annual Drunk Driving Audit, which counts operating-while-intoxicated (OWI) arrests reported by every police agency in the state. For each agency it records how the arrest was tested: by breath, by blood, or by refusal.

The 2025 audit lists 668 agency records across 83 counties. City and township police departments made 13,832 arrests (56%). County sheriffs made 6,277 (25%), and Michigan State Police posts made 4,222 (17%). Campus, tribal and other agencies made the remaining 359.

Blood tests now outnumber breath tests. 50% of arrests involved a blood draw, for example when drugs are suspected, or after a breath-test refusal when police seek a warrant. About 1 in 5 drivers refused testing, which brings an automatic license suspension under Michigan’s implied consent law.

Where you’re most likely to be arrested for DUI in Michigan

Raw arrest totals favor big cities, so we rank cities by OWI arrests per 10,000 residents. By that measure, the highest rates in 2025 were in northern Michigan resort towns and Upper Peninsula cities like Boyne City, Petoskey and Menominee. Downriver and inner-ring Detroit suburbs such as Wyandotte, Ferndale and Fraser came next. Small populations, seasonal visitors and police departments that also patrol beyond city limits can push per-capita rates well above what the resident count alone would suggest.

Counts are arrests made by each city’s own police department. They can include arrests just outside city limits and leave out sheriff or State Police arrests inside the city. Population figures are U.S. Census Bureau July 1, 2025 estimates. Court assignments are for misdemeanor OWI; felony cases move to the county circuit court. Courts and judges verified as of October 24, 2026 against the Michigan courts directory and each court’s website; a case is assigned to one judge within the court.

Michigan OWI penalties at a glance

Michigan calls drunk driving Operating While Intoxicated (OWI). The legal limit is 0.08 BAC (0.04 for commercial drivers). Drivers under 21 face “zero tolerance” charges at any detectable alcohol, and a BAC of 0.17 or higher triggers Michigan’s high-BAC, or “super drunk,” law.

Offense Jail / prison Fine Driver’s license Points
First OWI (0.08+ BAC) Up to 93 days $100 – $500 30-day suspension, then 150 days restricted 6
First OWI, high BAC (0.17+) Up to 180 days $200 – $700 1-year suspension (45 days hard, then restricted with ignition interlock) 6
Second OWI within 7 years 5 days – 1 year $200 – $1,000 Revoked, minimum 1 year —
Third OWI (lifetime) Felony: 1 – 5 years prison, or probation with 30 days – 1 year jail $500 – $5,000 Revoked, minimum 1 year (5 if another revocation within 7 years) —
Refusing a chemical test (1st) — — 1-year suspension; request a hearing within 14 days 6
